Mac Miller Being Sued Again For $10 Million For Sample Used On His 'Macadelic' Mixtape

 

For the second time in less than a month Mac Miller has been hit with a $10 million lawsuit for copyright infringement.

 

In July Lord Finesse filed a lawsuit against the Pittsburgh rapper, Datpiff and Rostrum Records for using his song “Hip 2 Da Game,” for Miller's “Kool Aid & Frozen Pizza,” track off of his Macadelic mixtape.

 

Yesterday Patrick Berlinquette, aka Warm Speakers, filed a lawsuit for the same amount against the same three parties according to HipHopDx. According the the lawsuit Miller sampled Berlinquette's song titled “The World Around You” and used it for a track titled "F*** Em All" without first getting permission.

 

 

“[Miller] uses other people’s music because it’s easier, cheaper, and faster than creating his own,” reads the complaint. “Miller seeks to capitalize on the common misconception in Copyright Law that people whose music he takes have no remedy if he gives their music away for free.”

 

Berlinquette claims he was “irreparably harmed, suffered damage, and defendants have profited in an amount to be determined at trial.” He is suing for willful infringement; violation of Copyright Law and New York’s General Business Law; and is seeking a permanent injunction. He is also suing for damages and seeks to recoup "no event less than $10 million."

you can't get sued if you give the music out there for free. just put for promo use only and you wont get sued. that fool aint getting nothing from the mac!!!!!

If your NOT a PRODUCER then you wouldn't understand....It's NOT fair that artist can take peoples music and put it out as a MIXtAPE while they make profits from PERFORMING the records at their shows. The producer gets NOTHING....
However, $10 mill is RIDICULOUS....But ya if your NOT a PRODUCER, then you shouldn't even speak on this situation because you don't know how it feels to not be compensated for your work.

God Damn.....I know Rostrum aint too happy about this. But its their mishap in my opinion. Clearances should have been established before it released under their label. Now they gone have to settle with some of the Wiz Khalifa money.
